Caterpillar Incorporated has sued to block the release of Disney's ''George of the Jungle Two.''

The heavy equipment maker alleges that the direct-to-DVD movie damages Caterpillar's reputation.

The trademark infringement lawsuit contends the movie ties Cat to an ''evil army'' seeking to destroy the jungle. The lawsuit contends that could have a negative effect on children and hurt sales of Caterpillar's products.

The suit asks for a temporary restraining order to block Tuesday's scheduled release of the movie. Caterpillar also wants the judge to order Disney to destroy all offending material.

Oh  puh-lease,

I guess the old adage of "any publicity is good publicity" is officially dead.

Add this to the list of similar suits -- like Wham-O suing the filmmakers of "Dickie Roberts Child Star" because David Spade was shown sqeaking to skin-peeling stop when he tried to slide on their Slip-n-Slide toy with no water. They said that it misrepresented the toy as being dangerous.

With the way that product-placement works in the entertainment industry -- with corporations shelling out big bucks to have their toys, beverages, and cars featured in these productions -- one has to wonder if Caterpillar was contacted before the movie was made.

I mean -- if the bulldozers have the CATERPILLAR brand name emblazoned on them -- I believe that the film company's legal department (Disney has a lawyer right?) would've had to sign an agreement with Caterpillar. If they did -- then someone at Caterpillar should have asked how their name was being used.

If they didn't -- do they honestly believe that the budding contractor currently in the 4th grade will grow up and buy his earthmovers from someone else -- lest the evil Caterpillar corporation take over the world?

On the other hand -- the last time I bought a Road-Runner-Catching Kit I went with someone other than ACME for fear that I might get flattened by an anvil. :hurt:

Disney says blocking movie would cost $9 million

Halting next week's release of a movie that Caterpillar Inc. contends will damage its reputation would cost the Walt Disney Co. at least $9 million, attorneys for the entertainment giant told a federal judge Thursday.

The money has already been spent to promote Tuesday's scheduled direct-to-DVD release of "George of the Jungle 2," and Disney would have to remarket the movie, said Disney attorney Matthew Neumeier.
Chief U.S. District Judge Joe B. McDade said he will take the weekend to review the case before ruling.

David Fleming, an attorney for Caterpillar, said the sequel links the Peoria-based company to the movie's villains and "is contrary to the image that Caterpillar has built since 1904."

Fleming said an "evil attacking army" uses Caterpillar Wheel Loaders to pursue the movie's hero and destroy the jungle, creating the incorrect impression that the company is unconcerned about the environment.

The movie also will have a negative effect on young viewers, which could affect Caterpillar's line of children's toys and clothing, Fleming said.
